Concessions offered to the gem and jewelry industry

Imports:
A) Duty free imports of
  1. Pearls, rough gems, cut and polished gems, diamonds, synthetic gems, diamond powder
  2. Gold (in all forms)
  3. Silver (in all forms)
B) Imports on a concessionary duty basis
  1. Tools, machinery and equipment used in the gem and jewelry industry.
C) Import and supply of following items are subject to 15% value added tax (VAT)
  1. Pearls, Diamonds, Precious and Semi Precious gems.
  2. Precious metal or metal clad with precious metal and gold coins.

Exports:
  1. Duty and tax free export of cut and polished gems, plain gold jewelry and gem studded jewelry.
  2. Direct export earnings are totally exempted from income tax.

Color cards issued by the National gem and Jewelry Authority

NGJA has introduced a scheme where color cards are issued along with the gem dealers license depending on the stock value as shown below.

  • Above Rs.5.00 million - Platinum
  • From Rs.3.00 - Rs.5.00 million - Gold
  • From Rs.1.00 - Rs.2.00 million - Silver
  • From Rs.100,000 - Rs.500,00 - Bronze
  • From Rs.50,000 - Rs.100,000 - White
The above color cards enable the holder,
  1. To establish his identity and capacity when dealing with the authority.
  2. To gain recognition in the society as a registered gem dealer and obtain priority in dealing with the authority.
  3. To engage in business activities openly & more conveniently.
  4. To gain recognition and prestige in overseas business activities.

BIMST-EC

(Bay of Bengal Initiative for Multi Sectoral Technical & Economic Co-operation)

The 'NGJA' was nominated as the "Focal point" for the second term in the gem and Jewellery sub sector for the BIMST-EC which includes Bangladesh, India, Myanmar, Sri Lanka. Thailand, Nepal & Bhutan.

Facilities offered to the Exporters by the National Gem & Jewelery Authority

  1. Service Fee waivers on Merchandise taken out for Trade Fairs & Exhibitions recognized by the "NGJA".

  2. Service Fee waivers on merchandise taken out for Trade Fairs & Exhibitions where, Sri Lankan participation is organized by the Export Development Board.

  3. Refund of Service Fee levied on unsold merchandise taken on consignment basis.

  4. Special, all inclusive Service Fee of Rs. 50/00 per parcel with a FO.B. Value up to US $ 150/00; on E-Commerce - Internet Sales.

  5. Round thl' clock export facilitation at the 'NGJA' Office at Air Cargo Village. Katunayake.

  6. Buyer - Seller meetings with the participation of Internationally renowned companies.

  7. assistance for placement under suitable Customs procedure for the entitlement of VAT and PAL exemptions. for those who import Diamonds. Gemstones. Gold etc .. for inward processing and re-export.

Kimberly Process Certification Scheme (KPCS)

Under the "Kimberly Process Agreement" (KPA) diamond mining, processing and trading countries agreed to establish legislation to eliminate trade in "Conflict Diamonds" (Diamonds that originate in area controlled by forces fighting the legitimate and internationally recognized government of the relevant country).

Sri Lanka became the 30th country to sign the "KPCS" to enable Sri Lankans ot legitimately import and export diamonds.

The above scheme was put into operation with effect from 1st January 2003.

The government of Sri Lanka has nominated the National Gem and Jewelry Authority as the official body for implementing and certification under the "KPCS".

As at October 2004, 43 countries have signed the Kimberly Process Agreement.

Procedure on export of rough Geuda


Procedure on export of rough Geuda from the export division at the head office of National Gem and Jewelry Authority:

Foreign Nationals: In the case of foreign nationals registration as well as export of Geuda are handled only at the geuda Testing Center, Ratnapura.

Sri Lankan Nationals: Sri Lankan nationals intending to export Geuda through National Gem and Jewelry Authority head office or Ratnapura Geuda Testing Center are required to adhere to the following procedure.

  1. Rough Geuda stones are to be examined and valued by two gemologists from NGJA and a Gemologist from Sri Lanka Customs prior to the preparation of the Export Invoice, based on such valuation.

  2. The exporter is required to furnish documentary proof of inward remittance equivalent to the value of intended export and received sole for such Geuda export subject to minimum value of US $5000/-. The bank certificate received at the time of conversion to local currency must be surrendered at the time of export. Commission to the authority should be paid in foreign currency. If the exporter intends to dispatch the geuda in several batches, remittance should be utilized in full within 45 days of the 1st export.

  3. Export of Geuda is allowed only on weekdays and all rules and regulations governing to the export of other gemstones are equally applicable for such export.

Procedure for export of gems and jewelry

All gem and jewelry exports should be chanelled through the Export Division of the National Gem and Jewelry Authority, at No.25, Galle Face Terrace, Colombo 03 or Gem Center - Ratnepura or Diamond Export Center, Cargo Village, Air Port - Katunayake.

  1. The prospective exporter should obtain a Gem Dealers Licence (This licence could be obtained for varying amounts depending on the maximum stock you will hold at any given time) to cover the value of the merchandise to be exported.

  2. Exporters who wish to export their Gems and Jewelry should bring their goods to the Export Department - National Gem and Jewelry Authority along with following documents before 3.00pm on all working days & 12.00 noon on Saturdays. Eight (08) copies of Commercial Invoice, which are to be used as follows
    1. Export Manager - Original
    2. Sri Lanka Customs - 2nd copy
    3. NGJA statistics division - 3rd copy
    4. 4th copy to be used to make relevant payments to NGJA
    5. Statistics division - Customs
    6. 6th to 8th copies are released to the exporter. They are used to obtain insurance cover for air mail / air freight purposes, GSP certificate (Gem Certificate), Carnet Certificate and a copy to be retained by the exporter.

  3. Invoice
    The following details should be given in the invoice.
    1. Exporters name and address
    2. Buyers name and address
    3. Buyers bank address
    4. Terms of payment
    5. Exchange rate prevent on the date of export
    6. Total F.O.B. value
    7. Insurance
    8. Freight
    9. Total C.I.F. value
    10. In case of jewelry, complete break up of the item should be given(weight and karattage of metal, variety & weight of stones)

  4. when the Invoices are presented to the Export Office, a number will be allocated to each invoice. Then the exporter will be called upon to hand over his goods to the Export Manager / Assistant Manager. Items will be individually weighted, cross checked with the invoice and accepted for export and will be sealed temporarily till it is submitted for examination. Invoices should be handed over to the officials, who will check the calculations and the entries.

  5. The parcel will be examined at the Examination table by National Gem and Jewelry Authority gemologist / valuer and customs gem appraiser / gemologist in the presence of the exporter or his/her representative. The examination is carried out to ensure the export of genuine gems and to avoid under or over invoicing. After examination the parcel will be sealed with sealing wax by the NGJA official, customs official and the exporter. Exporter is advised to bring his own seal, tin box and brown paper for this purpose. If any synthetic stones are detected and if they are not declared in the invoice as synthetic stones, these will be confiscated by the NGJA.

  6. The sealed parcel is kept back with the NGJA and four copies of the invoice will be handed over the exporter duly acknowledge by the export manager for the receipt of the parcel.

Then the exporter is required to obtain insurance coverage for the parcel and pay the export sevices fee on F.O.B. value to National Gem & Jewelry Authority. The exporter should get the airway bill from the respective air line office and get a confirmation of the date and air line which air freights the Gem and Jewelry Parcel to the destination.
